Take Point Fitness (“we”, “us”, “our”) is responsible for the collection and use of personal information described in this Privacy Notice.

Where required by the laws of England and Wales, we act as the data controller (or equivalent) for the personal data we process.

Scope of This Notice

This Privacy Notice explains how we collect, use, disclose, store, and protect personal information when you:

  • Visit our website or use our services,
  • Communicate with us.
  • Create an account, or
  • Otherwise interact with us.

Information We Collect

We may collect the following categories of personal information:

Information you provide directly

  • Name, email address, phone number
  • Account credentials
  • Payment or billing information
  • Messages, support requests, or feedback
  • How you heard about us, asked once at sign-up

Training and health-related information

The service is a training app, so most of what it holds describes your body and your exercise. You enter this yourself, and you can view, change or delete it in the app at any time:

  • Sex, age, height and bodyweight, including a history of bodyweight entries
  • Training records — the sessions you plan and log, the loads, reps and times you record, personal bests, and test or benchmark results
  • Experience level, goals, available equipment and training preferences
  • Injuries, pain or movement restrictions, where you choose to record them, and exercises you have marked as ones you cannot or prefer not to do

Some of this may count as health data under data-protection law. We ask for it only because the app cannot prescribe training without it, we do not use it for advertising, and we do not sell it. If you link to a coach, see Sharing of Information below for what they can see.

The “Help us improve TPF” questionnaire

The app offers an optional in-app questionnaire about your training, the equipment and time you have, which parts of the app you use, and what you think of it. Please note:

  • It is entirely voluntary. Every question is optional and nothing in the app is withheld if you skip it or never open it.
  • Your answers are linked to your account — they are not anonymous. This is deliberate: it lets us read what you told us alongside how the app is actually working for you.
  • When you submit, we attach a snapshot of information already held on your account so we do not have to ask you for it again. That snapshot covers your sex, an age band, bodyweight, experience level, training goal, subscription plan, which edition of the app you use, how long you have had an account, and how you told us you heard about us.
  • We keep one set of answers per person, which you can reopen and change. If you submit again, the newer answers and a fresh snapshot replace the previous ones.
  • Responses are stored on our own systems. We do not pass them to a third-party survey provider.

We use the responses to decide what to build, fix and change. Deleting your account deletes your questionnaire response with it.

  • IP address and approximate location
  • Usage data, logs, and analytics
  • Cookies and similar technologies

Information from third parties

  • Payment processors
  • Analytics or service providers
  • Identity or fraud-prevention services

Apart from the training and health-related information described above, which the service cannot work without, we do not intentionally collect sensitive personal data unless strictly necessary and consented to and permitted by law.

How We Use Personal Information

We use personal information for the following purposes:

  • To provide and operate our services
  • To generate your training plan, progressions and scores from the training and health-related information you enter
  • To manage accounts and transactions
  • To communicate with users
  • To improve performance, security, and functionality
  • To understand how the service is used and decide what to build next, including by reading questionnaire responses alongside the responding account
  • To comply with legal and regulatory obligations
  • To prevent fraud and misuse

We do not sell personal information.

Legal Bases for Processing

Where required, we rely on one or more of the following legal bases:

  • Your consent
  • Performance of a contract
  • Compliance with legal obligations
  • Legitimate business interests that do not override your rights

Sharing of Information

We may share personal information with:

  • Service providers acting on our instructions
  • Payment and hosting providers
  • Professional advisers (e.g. legal, accounting)
  • Authorities where required by law

All third parties are required to protect personal information and use it only for authorised purposes.

International Data Transfers

If personal information is transferred outside of your country of residence, we ensure appropriate safeguards are in place, such as:

  • Standard contractual clauses
  • Adequacy decisions
  • Other lawful transfer mechanisms

Data Retention

We retain personal information only for as long as necessary to:

  • Fulfil the purposes described in this Notice,
  • Meet legal, accounting, or regulatory requirements, and
  • Resolve disputes or enforce agreements.

Automated Decision-Making and Profiling

We may use automated systems or tools to support functions, such as:

  • Service personalisation,

These processes do not produce legal or similarly significant effects without meaningful human involvement.

Where automated decision-making or profiling is used:

  • It is limited to what is necessary for the stated purpose,
  • Appropriate safeguards are applied, and

Opting out of marketing communications will not affect:

  • Transactional or service-related messages, or
  • Legally required communications.

Where marketing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.

Children’s Privacy

Our services are not directed to children, and we do not knowingly collect personal information from individuals under the age of 18 without parental consent. If we become aware that such information has been collected without appropriate consent, we will take steps to delete it.

Security Measures

We implement reasonable technical and organisational measures to protect personal information from:

  • Unauthorised access,
  • Loss, misuse, or alteration.

No system is completely secure, but we continuously review and improve our safeguards.

Changes to This Notice

We may update this Privacy Notice from time to time. Changes will be posted with an updated “Last Updated” date.
